Terms of Use

1. Acceptance

By creating an account or using Marteso ("the Service"), you agree to these Terms of Use ("Terms"). If you do not agree, do not use the Service. These Terms form a binding agreement between you and Aglo Solutions s.r.o., registered at Lužná 5, 851 04 Bratislava, Slovakia ("we", "us", "our"), the operator of Marteso.

2. The Service

Marteso is an App Store Optimization platform that provides keyword tracking, metadata management, competitor analysis, and related tools for iOS developers. We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice.

3. Eligibility

You must be at least 18 years old and capable of entering into a legally binding agreement to use Marteso. By using the Service, you represent that you meet these requirements. If you use Marteso on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

4. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify us immediately at [email protected] if you suspect unauthorized access. We are not liable for losses resulting from unauthorized use of your account.

5. Acceptable use

You agree not to:

• Use the Service for any unlawful purpose or in violation of these Terms.
• Reverse engineer, decompile, or attempt to extract the source code of any part of the Service.
• Scrape, crawl, or otherwise harvest data from the Service in ways that exceed normal use or circumvent rate limits.
• Introduce malware, viruses, or any harmful code.
• Resell or sublicense access to the Service without our prior written consent.
• Use the Service to infringe any intellectual property rights of third parties.

6. Subscriptions and billing

Marteso is offered on a subscription basis. By subscribing, you authorize us to charge the applicable fee on a recurring basis. Fees are listed on our pricing page and may change with 30 days' notice. All fees are exclusive of applicable taxes unless otherwise stated.

Subscriptions auto-renew unless cancelled before the renewal date. You may cancel at any time; cancellation takes effect at the end of the current billing period. We do not provide refunds for partial periods except where required by law.

7. Intellectual property

All content, features, and functionality of the Service — including software, design, trademarks, and documentation — are owned by Aglo Solutions s.r.o. or its licensors and are protected by applicable intellectual property laws.

You retain ownership of all data you upload or connect to Marteso ("Your Content"). You grant us a limited, non-exclusive license to process Your Content solely to provide the Service to you.

8. Disclaimer of warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be error-free, uninterrupted, or that results obtained will be accurate or reliable.

9. Limitation of liability

To the maximum extent permitted by law, Aglo Solutions s.r.o. and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Service, even if advised of the possibility of such damages.

Our total aggregate liability for direct damages shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Governing law

These Terms are governed by the laws of the Slovak Republic, without regard to conflict of law principles. Any disputes shall be submitted to the exclusive jurisdiction of the courts of Bratislava, Slovakia, unless mandatory consumer protection laws in your jurisdiction provide otherwise.

11. Changes to these Terms

We may update these Terms from time to time. We will notify you by email or in-app notification at least 14 days before material changes take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
